Parkland Hospital Wins Lawsuit Against Man Injured in Shootout With Police

DALLAS – A United States magistrate judge in Dallas has ruled in favor of Parkland Hospital in a lawsuit brought by a Texas prison inmate currently serving time for shooting two Irving police officers.

Jerry Wayne Mooney, 35, of Irving sued Parkland Hospital and Dallas County over treatment he received at the hospital and at the Dallas County Jail following an October 2002 shootout with Irving police. Mooney shot and injured two Irving police officers while suffering gunshot wounds to his abdomen and legs.

Mooney, who suffers from bipolar disorder, spent more than a month at Parkland before being transferred to the Dallas County Jail. In September 2005, he pleaded guilty to one count of aggravated assault on a public servant and was sentenced to 45 years in prison. While he admitted that the medical staff at Parkland saved his life, Mooney later sued the hospital claiming it and the county had violated his civil rights by denying him medical and psychiatric care.

In his ruling, U.S. Magistrate Judge William F. Sanderson Jr. found Mooney received “a formidable array of medical and psychiatric care, prescription medications, medical supplies, and tests at no charge.” Noting that Mooney was the subject of four life-saving surgeries and that his monitoring and treatment continued for nearly three years, both at Parkland and at the Dallas County Jail, the judge granted Parkland’s motion for summary judgment in the case.
